GENERAL
– These conditions apply to products sold by Tri Nature Pty Ltd (Tri Nature / the supplier) and shall prevail over any conditions on the Customer’s (the applicant’s / you / your) order.
ORDERING
– Orders can be faxed or emailed to Tri Nature by using the ‘Wholesale Price List Order Form’. Please email orders to [email protected].
– Wholesale accounts are expected to meet a minimum of $500 ex GST in orders per month.
PRICING
– Prices are subject to change without notice. Prices charged will be those ruling on the date of order receipt. – All goods sold are subject to the ‘A New Tax System (Goods and Services Tax) Act 1999’.
– All prices shown in any of Tri Nature’s publications including retail prices list, brochures, electronic media and other advertising material are recommended selling prices only. There is no obligation on the part of the reseller to maintain the same price.
PAYMENT OF GOODS
– All orders are to be paid in full prior to dispatch. Payment may be made by VISA, MasterCard, PayPal or Direct Deposit.
– If payment is by direct deposit, goods will not be dispatched until the funds have cleared.

FREIGHT CHARGES
– Freight is charged on a per order basis. FREE freight for orders over $1000.00 ex GST. – Please note that freight charges are subject to change without notification.
RISK & SHIPPING
– You will receive an automated confirmation email from Tri Nature when your order has been shipped that includes tracking information.
– Orders are delivered through Star Track or Australia Post with an estimated shipment time of 3-10 business days from date of despatch, and will be shipped to one address only. Drop shipment is not available.
– To ensure the delivery arrives to the correct destination and on time, please ensure that someone is available to sign and take receipt of the delivery.
– The risk in the goods purchased shall pass to you upon delivery to the nominated delivery address.
– Tri Nature shall not be held responsible for losses arising from delay in delivery or non-delivery by reason of war, fire, accident, fuel or power shortage, strike, labour dispute, restriction of transport facilities, or any other cause beyond its control.
RETURNS
– Any items that arrive broken or faulty will be replaced if we are notified within 7 days of receipt. For items that arrive broken or damaged, please email a photograph within 7 days to [email protected] and a member of Tri Nature’s customer service department will guide you through the replacement process.
– If for any reason there is an issue with the order (incomplete or incorrect), please email [email protected] within 7 days of receipt of the order and a member of Tri Nature’s customer service department will guide you through the replacement process.
– To be eligible for any other returns, the item must be unused, unopened & in the original packaging. Please email [email protected] within 7 days of receiving the order with a note briefly outlining the reason for return. A member of Tri Nature’s customer service department will then be in contact and will and guide you through the returns process. Please note Tri Nature does not cover any of the return shipping costs. Once these items are received back, their condition will be reviewed. Any items not in resalable condition will not be credited. For all other returns a credit will be issued on your account that will be valid for 60 days. Please note that Tri Nature do not do cash refunds.
– Any claims for damage or partial loss of product in transit must be notified in writing to Tri Nature within seven (7) days of delivery. In the absence of notification, the product is considered to be delivered in accordance with this contract (to the extent permitted by law).
IMPLIED WARRANTIES
– All implied terms, conditions and warranties (whether statutory or otherwise) are, to the extent lawfully possible, excluded. Tri Nature’s liability for any breach of term, condition or warrant shall, to the extent lawfully possible, be limited (at Tri Nature’s option) to the replacement of the product or equivalent product, or payment of the cost of replacing the product or acquiring an equivalent product.
SUITABILITY OF USE
– Any advice from Tri Nature on the product of Tri Nature or a third party is given in good faith. It is up to the Customer to ensure that the product ordered is suitable for its intended use.
– As Tri Nature has no control over the treatment or use of the product, Tri Nature is unable to give any warranty other than that stated in this contract.
PATENTS & TRADEMARKS
– Nothing in these terms and conditions shall be construed as granted or implying the grant of any license under any patent or trade mark rights or any other industrial property rights held by Tri Nature.
INDEMNITY
– The Customer indemnifies Tri Nature for any and all direct, special, indirect and/or consequential loss or damage, however caused to the Customer and/or to third parties that results as a consequence of Tri Nature supplying, or failing to supplying at all or in time, the goods to the Customer, or to any third party under or in association with this agreement.
WAIVER & NOTICE
– Waiver of any right, power, authority, discretion or remedy arising on a breach or a default under this agreement in force between Tri Nature and the Customer must be in writing and signed by the party granting the waiver.
– Any notice or communication to or by a party under these terms and conditions must be in legible writing in English an address to the other party as specified in this application.
ASSIGNMENT
– The Customer must not assign or otherwise purport to transfer its rights or obligations under these terms and conditions to any other person without prior written consent of Tri Nature.
GOVERNING LAW
– This contract shall be governed by the laws of the State of New South Wales, Australia.
ENTIRE AGREEMENT
– Tri Nature and the Customer agree that these terms and conditions and the Customer’s order constitute the entire agreement between the parties in relation to the Sale of Goods and that there are no other understandings or representations forming part of the agreement between the parties.
PRECEDENCE
– These terms and conditions in respect to goods ordered shall take precedence to any other terms or conditions set out in the Customer’s order that deviates from or is inconsistent with these terms and conditions.
AMENDMENT
– Tri Nature reserves the right to review and amend these terms and conditions from time to time. Written notification forwarded to the Customer by ordinary mail or email shall be sufficient notification to bind the Customer to any revised or amended terms and conditions for all orders placed by the Customer and accepted by Tri Nature after the date of such notification.
ADDENDUM
– Tri Nature products are only to be retailed in their original packaging.
– No salesman, representative or agent is authorised by us to give a guarantee, warranty or representation in addition to, or contrary to these conditions.
